Terms and conditions of use

1. Acceptance

By browsing the Platform, creating an account or using it, you accept these terms and our Privacy notice. If you do not agree, do not use the Platform. If you act on behalf of a company, you represent that you have authority to bind it.

2. Who provides the service

GoTapp Servicios Financieros, S.A. de C.V., Sociedad Financiera de Objeto Múltiple, Entidad No Regulada, trading as GoTapp, tax ID (RFC) KMO250225RQ1, with address at Av. Lázaro Cárdenas 3454-6, int. B6-B7, Col. Jardines de los Arcos, C.P. 44500, Guadalajara, Jalisco, Mexico ("GoTapp").

3. Scope of these terms

The Platform lets you learn about GoTapp services, sign up, onboard your company and, once approved, manage its products. The economic and legal conditions of each product (fees, rates, term, grounds for termination) are set out in its contract; in case of conflict, the product contract prevails.

Information on the Platform is informational and is not a binding offer. Approval of an application depends on identity and company verification and on GoTapp policies.

4. Permitted use

You agree to use the Platform lawfully and not to:

• Provide false or incomplete information, or information of third parties without their authorization.
• Use the Platform for money laundering, terrorist financing, fraud or any other unlawful activity.
• Access accounts, systems or data without authorization, or attempt to bypass their security controls.
• Interfere with the operation of the Platform, automate access without our permission or reverse engineer it.

GoTapp may suspend or cancel access, and report to the competent authorities, when it detects use contrary to these terms or the law.

5. Accounts and security

• You are responsible for keeping your credentials, the verification codes you receive and your mobile device confidential.
• The Platform may require additional verification (for example, an email code, a one-time code or your device biometric unlock) to access it or authorize transactions. Device biometrics are managed by your phone; GoTapp does not receive your fingerprint or face.
• Do not share your credentials or codes. GoTapp will never ask for them by email, message or phone.
• Tell us immediately if you suspect unauthorized access or lose your device. You can sign out sessions and block your cards from the Platform.
• Transactions made with your credentials and verification mechanisms are deemed made by you, unless you prove otherwise under the law and your contract.

6. Intellectual property

The Platform, its software, design, texts, trademarks and logos belong to GoTapp or its licensors and are protected by law. We grant you a limited, revocable, non-exclusive license to use it under these terms. Visa and other third-party marks belong to their owners.

7. Availability

We strive to keep the Platform continuously available, but it may be interrupted by maintenance, provider failures or causes beyond GoTapp control. We may modify, suspend or discontinue features; where this affects a contracted product, the terms of its contract apply.

8. Limitation of liability

To the extent permitted by law, GoTapp is not liable for indirect damages, for interruptions beyond its control, for misuse of your credentials or device for reasons not attributable to GoTapp, or for information provided by you or third parties. Nothing in these terms limits liability that the law does not allow to be limited, or the rights you have as a user of financial services.

9. Regulatory status of GoTapp

GoTapp Servicios Financieros, S.A. de C.V., Sociedad Financiera de Objeto Múltiple, Entidad No Regulada, for its incorporation and operation as such, does not require authorization from the Ministry of Finance and Public Credit (SHCP) and is subject to supervision by the National Banking and Securities Commission (CNBV) solely for the purposes of article 56 of the General Law of Credit Organizations and Auxiliary Activities. This legend is included under article 87-J of that Law; the supervision referred to concerns the prevention of money laundering and terrorist financing (articles 56 and 95 Bis). GoTapp does not take deposits from the public.

12. Governing law and jurisdiction

These terms are governed by the federal laws of the United Mexican States. For their interpretation and performance, the parties submit to the competent courts of Guadalajara, Jalisco, without prejudice to the rights the law grants you before CONDUSEF or other authorities.

13. Changes to these terms

We may update these terms. We will publish the current version on this page with its last-updated date and, if the change is substantial, notify you by email or on the Platform. If you keep using the Platform after the notice, you accept the changes; if you disagree, stop using it.
